1.   CANCELLATION

If the tenant does not take possession of the rented premises, he is nevertheless required to pay the rental amount for the period covered by this agreement without being able to demand any reduction unless the agent can find a replacement for him. In this case, the agent has the right to charge the costs resulting from finding a new tenant.
The tenant benefits from a full refund if he/she cancels the lease up to 30 days before arrival. After this period, the forfeit guarantee included in the rent allows the tenant to cancel the lease in the event of force majeure: illness, serious accident - on the provision of a medical certificate, the death of the tenant, a direct descendant or parent, parents in law, major damages caused to the tenant’s property urgently requiring his presence at home. Excluded from the insurance are illnesses and accidents which began before the lease signature date. The cancellation must be communicated to the agent within forty-eight hours following the reason for the cancellation. If the agency approves the termination of the lease, the tenant will receive a refund of the amount paid, with a deduction of a 4% insurance policy fee based on the rental amount.
The tenant must accept the rented housing and cannot request the agent to change it.


2.   TAKING POSSESSION

On taking possession of the accommodation, the tenant shall carry out an inspection of the property. If he notices any damage to the building or furniture, he shall inform the agency within the two working hours following his arrival.


3.   OCCUPATION

The premises are only intended for habitation and cannot be used for any other purpose. The tenant must not sublet the premises without explicit permission. It is strictly prohibited to exceed the maximum number of people allowed. If the premises are occupied by more people than authorized without the owner's knowledge, the tenant will be responsible for paying for each additional occupant, which can cost up to double the amount paid for an authorized person. Permission from the lessor is required for any pets, with a supplement of CHF 10.-/night. The agency or owner may visit the premises at any time. The tenant wishing to stay with elderly or disabled individuals must find out about the access facilities before the conclusion of the lease.


4.   MAINTENANCE

The tenant is responsible for maintaining the furniture and existing equipment in the accommodation, including electrical facilities, heating equipment, bath, toilet, etc. The tenant must keep them in good condition and return them in the same state, except for normal wear and tear. As per the terms of the tenancy agreement, the tenant is responsible for any damages that arise as a result of their actions, such as damage to equipment, frozen pipes, or other similar issues. It is expected that the tenant will take all necessary precautions to prevent these issues from occurring. The tenant must promptly notify the agent of any necessary repairs. Any costs incurred for such maintenance shall be the tenant's sole responsibility if ordered by the tenant without the owner's prior knowledge or consent. The furniture, decoration objects, and other items must remain in their original position as per the agreed terms of the lease agreement. While occupying the rental property, the tenant is responsible for regularly cleaning and maintaining the premises. This includes proper disposal of household waste in designated containers using taxed bags available at local supermarkets. The tenant is expected to clean and put away the dishes, keep the cupboards and fridge clean, and clean the cooker and oven after each use. The final cleaning is not included in the rent.


5.   SERVICES

Before the arrival of the tenant, the owner must clear the snow from the paths and prepare the accommodation. The agency and owner cannot be held responsible for any irregularities in water services or for the clearing of snow from the roads. In general, they do not accept liability for any loss of enjoyment that is not their fault. In the event of a power outage, electricity in particular, during the rental period, and which is not the result of any fault on the lessor's part, the tenant cannot raise any claim, and the rent will remain the same.


6.   CHARGES - INSURANCE

Heating, hot water, and electricity charges are included in the rental price. The tenant agrees to use it sparingly. If the energy consumption is exceptionally high or the accommodation is abnormally maintained, the agency reserves the right to collect the excess costs from the tenant. Telephone costs, wood for the fireplace are the tenant's costs. Furniture and real estate insurance are the responsibility of the owner, while that concerning the personal effects of the tenant is the responsibility of the latter.


7.   TOURIST TAX

The tourist tax is compulsory and at the cost of the tenant who shall fill out the pre-arrival form and provide the agency with the necessary and exact information in compliance with the cantonal law of November 13 1975.


8.   DEPARTURE

Before leaving, the tenant must inform the agency or owner of any damages that occurred during their stay. If any items are missing, damaged, destroyed, incomplete, broken, or cracked, the tenant is responsible for paying the cost price. The initial inventory approved upon arrival will be used to determine the tenant's liabilities upon departure.


9.   DISPUTES

This agreement is considered as an acknowledgement of debt in the sense of article 82 LP, for the rent as well as for all the sums owed by the tenant by virtue of the provisions that it contains. For all the details not specified in this agreement, the terms in the Federal Code of Obligations apply, notably the Articles 253 et seq. For all disputes which may result from the interpretation, fulfillment, non-fulfillment, or application of this agreement, the tenant declares that his service address, conferring jurisdiction, is the competent authority of the place where the accommodation is situated.
